JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned Counsel Mr. Kinariwala stated that the amount in terms of the previous order dated 21.9.2012 is by now deposited. He further submitted that in spite of service of notice upon respondent No.3, no one is present for the respondent through their power of attorney holder and a huge amount exceeding Rs.2,74,00,000/- is by now deposited for the purpose of payment of compensation as stated earlier. Under the circumstances, notices are ordered to be issued to two persons, joined as respondent No.3, for being directly served by the applicant for ensuring their presence before the application is finally disposed. The office shall issue fresh notices in the name of the respondent Mr. Mohmmad Muse Dadabhai and Sabir Muse Dadabhai which shall be served on them directly by the applicant and the notices shall be made returnable on 27.11.2012.
Direct service is permitted.
