Heard learned counsel for the petitioner and Shri Ramakant Dubey, learned State Law Officer for the State respondent no.1.
Notice need not be issued to the private respondent nos.2 to 5, in view of the order proposed to be passed.
The petitioner is before this Court with request to issue direction to the first respondent, Commissioner, Azamgarh Division, Azamgarh to decide the Revision No.00174/2018, Computer Case No.C201815000000174 (Viddya Nivas Chaubey vs. Sub Divisional Officer and others) under Section 219 of Land Revenue Act, pending since 17.1.2018 within stipulated time.
Learned State Law Officer fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent to expedite the proceeding of the aforesaid revision and decide the same, after giving opportunity of hearing to the private respondent nos. 2 to 5, without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.150/-.
