1. Mr. Kishor M Paul, learned advocate for the petitioner has submitted that the petitioner has no grievance against the direction to reinstate the respondent. He submitted that the petitioner is ready and willing to reinstate the respondent. Actually he clarified that the petitioner had requested the respondent to resume duty. Mr. Paul, learned advocate for the petitioner has submitted that the petitioner's grievance is only against the direction to pay 30% backwages and the challenge in the petition against the award is also restricted to the said direction only.

Therefore, the petitioner is directed to forward written communication to the respondent informing him that he has HC-NIC Page 1 of 2 Created On Thu Aug 17 20:07:50 IST 2017 SCA/1904/2012 2/2 ORDER been reinstated in compliance of the award dated 26.5.2011 in Reference (LCA) No.772 of 2006 and that he should resume his duty. The said communication shall contain details about the date and time when the respondent should report for duty and also the name of the officer to whom he should report for duty. The petitioner shall place on record copy of the said communication on the next date of hearing. The communication shall be forwarded to the respondent by RPAD on or before 20.2.2012. On the said condition the grievance of the petitioner only qua direction to backwages is taken up for consideration and for that purpose office is directed to issue Notice to the respondent returnable on 19.3.2012.
