Heard Mr. S.C. Srivastava, learned counsel for the petitioner and Mr. Pawan Kumar Mishra, learned Advocate, holding for Mr. Pranjal Mehrotra, learned counsel for respondents 2 and 3.
The principal prayer made in the writ petition, reads thus:
“i) a writ, order or direction in the nature of commanding the respondent no.1 to pass a reason order on the impleadment application dated 11.6.2018 filed by the petitioner so that correct facts may be brought in his notice strictly in accordance with law within a period to be specified by this Hon'ble Court.”
The petitioner had earlier approached this Court by way of a writ petition bearing Writ-C No. 6823 of 2018, seeking direction to the concerned respondent to pass a reasoned/speaking order on the application/representation made by him. The writ petition was however disposed of with a direction to decide the show cause notice issued against the private respondent therein. Accordingly, we are informed, the show cause notice has been decided and against which an appeal is preferred by the private respondent. The petitioner by way of an application dated 11.6.2018 seeks impleadment as party in the said appeal.
In our opinion, the petitioner has no locus to seek such impleadment. The authorities have already initiated action and now a statutory appeal is pending, which, we hope, shall be considered and decided in accordance with law expeditiously. We may also observe that when the show cause notice was decided in view of the earlier order passed by this Court, the petitioner was not heard.
The petition is, accordingly, dismissed.
