Heard learned counsel for the appellant.
By means of this First Appeal, the appellant has challenged the order dated 29.9.2018 passed under Section 24 of the Hindu Marriage Act (in short the Act). The appellant got married with the respondent in 2014.
It appears that the appellant filed a suit being Suit No. 707 of 2015 for dissolution of Marriage by divorce under Section 13 of the Act. The respondent then filed an application under Section 24 of the Act for grant of interim maintenance as well as cost of litigation. At the time of filing of the suit the appellant was working with a private company whereas the respondent is still studying. Considering the status and education of the appellant the court has determined Rs. 8000/- per month as interim maintenance and Rs. 5000/- lump sum towards expenditure for litigation to attend the case to the wife.
The court has given sound reasoning to arrive at the aforesaid amount, which in our view, does not call for any interference.
The appeal has no merit and it is, accordingly, dismissed. However, the court below is directed to proceed with the said suit being Suit No. 707 of 2015 and decide the same in accordance with law without granting unnecessary adjournment to either of the parties.
