The petitioner is the 1st defendant in O.S.No.274 of 2014 of Munsiff's Court, Hosdurg and his property has been attached in a suit for recovery of money. 2. Before this Court, the only prayer made by the petitioner is that he is ready to pay off the debt in instalments and he may be allowed to do so. Since the suit is still pending before the court below, if the petitioner moves before the appropriate forum and raise his prayer before the lower court, that court will consider the prayer, if made by the petitioner in accordance with law.

This OP(C) is disposed of as above.
