JUDGMENT / ORDER

This writ petition is filed by the petitioner seeking for appropriate directions to permit him to continue the pantry car service in Train No.1635-16346, Nethravathi Express till the expiry of the five year period.
2. Learned Standing Counsel submits that originally the period for which the petitioner was granted licence was for five years which expired in 2009. Thereafter, his licence was being renewed on ad-hoc basis from time to time. Therefore, there is no specific period for which he has been appointed as a licensee and he is liable to surrender his rights, the moment another person is appointed as licensee after calling for tenders in the matter. Tenders have already been called for, same have been finalised and the work has been awarded to another person. Therefore, the petitioner has no right to continue the licence.

Having regard to the aforesaid factual situation, I do not think that the petitioner has any legal right to continue to hold the licence since his period has expired long back in 2009 and he has been continuing on the basis of the ad-hoc orders issued by the Railways. The moment the licence is revoked, the petitioner has no right to seek further extension.
Under these circumstances, there being no merits in the writ petition, the same is dismissed.
