Heard learned counsel for the revisionists and learned A.G.A. for the State.
It is submitted by learned counsel for the revisionists that the present matter relates to a matrimonial dispute between husband and wife and the said matter can be well considered by Mediation Centre of this Court.
It is directed that revisionists shall deposit a sum of Rs.15,000/- within two weeks' from today with the Mediation Centre out of which 90 % amount shall be paid to opposite party no.2 for her appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of two months after giving notices to both the parties.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, effect and operation of the order dated 25.3.2019, passed by the Session Judge, Shahjahanpur in Criminal Appeal No. 68 of 2017, (Vivek Vikram Singh and others vs. Smt. Nisha Yadav and another) as well as the ex-party order dated 18.05.2013 and order dated 28.01.2015, passed by Additional Civil Judge, Junior Division/Judicial Magistrate, Shahjahanpur in complaint case no. 758/2012 and complaint no. 354/14, respectively (Smt. Nisha Yadav Vs. Vivek Kumar Singh and another) shall remain stayed.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this petition shall stand dismissed automatically.
