JUDGMENT / ORDER

1.0 Present application is filed by the applicant - convict through jail seeking Temporary Bail for a period of 60 days so as to get himself operated. The Jail Remarks revealed that earlier he was released for the same purpose in the month of December 2011 - January 2012. The Statement of the convict is recorded, wherein, it is stated that he was granted bail, but could not get operated on account of non-arrangement of funds. He further stated that this time he has made arrangement for the funds by discontinuing education of his son and asking him to get cultivates his land on crop share basis.
2.0 Rule.
Learned Additional Public Prosecutor Mr. Patel waives service of process of Rule.
3.0 Taking into consideration the contents of the application, the application is allowed. The applicant - convict is ordered to be released on Temporary Bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
3.1 The convict shall surrender to the jail authorities on expiry of the Temporary Bail period.
3.2 The convict is directed to submit the Certificate of he having got operated himself.
3.3 Rule is made absolute to the aforesaid extent.
