The petitioner is running a cinema theater by name 'TNP Theater' at Karunagappally. In terms of the provisions under the Kerala Cinema (Regulation) Rules, 1988 the petitioner applied for a temporary licence and the same was issued on 16.4.2014, as is evident from Ext.P5. Going by Ext.P5 its validity is for 90 days. Prior to the expiry of the same the petitioner applied an application for getting a permanent licence. The contention of the petitioner is that if orders have not been passed on his application the petitioner would not be in a position to conduct the exhibition of cinematograph. It is in the said circumstances that the captioned writ petition has been filed mainly with the prayer to issue a writ of mandamus commanding the second respondent to issue a permanent licence before the expiry of Ext.P5. The petitioner has not produced the copy of the application submitted by him for getting a permanent licence and nothing is on record to W.P.(C) No. 14241 of 2014 2 reveal that he had, in fact, submitted an application. However, taking note of the contention of the petitioner that he has submitted an application for a permanent licence in terms of the provisions under the Kerala Cinema (Regulation) Rules, 1988 in respect of TNP Theater, Karunagappally this writ petition is disposed of, without making any observations as to the entitlement of the respondent to receive such a licence, with a direction to the second respondent to consider the application, if any, received for the aforesaid purpose from the petitioner, with all necessary documents, expeditiously and in accordance with law, at any rate before the expiry of the period of Ext.P5 temporary licence. To enable the second respondent to comply with the direction the petitioner shall produce a copy of this judgment before the second respondent within three days from the date of its receipt. Sd/-
