JUDGMENT / ORDER

The State of Karnataka By Kadur Police Station, Rep. by Special Public Prosecutor, High Court of Karnataka, Bengaluru -560 001. …Respondent (By Sri Chetan Desai, HCGP) This Criminal petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Crime No. 328/2016 of Kadur Police Station, Ramanagara for the offence P/U/S 395 of IPC.
This Criminal Petition is coming on for orders this day, the Court made the following:
ORDER The petitioners are arrayed as accused Nos.2 and 3 in the charge sheet submitted by the respondent- police in respect of the offence punishable under Section 395 of IPC.
2. The allegation is that these petitioners had looted the inmates of the car on the night of 28.10.2016 and fled away with their valuables. Since the stolen articles are recovered from the possession of accused Nos.1 to 3 and the investigation having been complete, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioners are enlarged on bail in Crime No.328/2016 of respondent-police, subject to the following conditions:
(i) They shall execute a self bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two local sureties for the likesum to the satisfaction of the concerned court.
(ii) The sureties shall furnish their Identity Card, Aadhar Card and original documents pertaining to the property for the perusal of the Court.
(iii) They shall attend the court regularly on all hearing dates.
(iv) They shall not threaten or prevail upon the prosecution witnesses.
