Heard.
2. Alleging inaction on the part of respondent Nos.1 and 2 in conducting investigation in F.I.R.No.116 of 2014, which was registered with Darsi Police Station as early as on 21.04.2014, the present writ petition is filed.
3. Learned Government Pleader, who has secured instructions, submits that the de facto complainant made a complaint of trespass into first floor of house against A1, A4 and A5 and he also cited independent witnesses L.Ws.3 and 4; that thorough investigation was being done and the evidence of L.Ws.3 and 4 also was recorded; that a civil suit being O.S.No.137 of 2013 is pending before the Junior Civil Judge, Darsi, between the parties and legal opinion is sought as to whether the alleged acts of the accused in entering the house amounts to house trespass or not.
4. It is evident from the above instructions that police have taken up investigation and are awaiting legal opinion on the question referred to above.
5. Since the investigation was already completed, it is just and appropriate to direct respondent Nos.1 and 2 to complete the investigation and file the final report within two months from the date of receipt of a copy of this order, before the jurisdictional court.
With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
