Petitioner approached this Court on account of non implementation of Ext.P6 issued by the Sub Collector, Fort Kochi. In Ext.P6, it is found that the 6th respondent has encroached upon a road puramboke in front of petitioner's building. It is also stated that road puramboke was within the Cochin Corporation and it is seen from the report of the Village Officer, Mattanchery that a new building is constructed near the old building by demolishing the compound wall. As the road puramboke is within the Cochin Corporation, Cochin Corporation was directed to take appropriate legal action in the matter.
2. In view of the above, there shall be a direction to the second respondent to take appropriate action in accordance with law after hearing the petitioner and the sixth respondent. Needful shall be done within a period of one month from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
