Criminal Original Petitions filed under Section 482 Cr.P.C. to modify the condition of the learned Principal sessions Judge, Salem, made in Crl.M.P.Nos.36 and 42 of 2017 respectively dated 20.1.2017 “the petitioner shall stay at Perambalur and report and sign before the learned Judicial Magistrate, Perambalur daily twice at 10.00 a.m. and 5.00 p.m. until further orders”.

For Respondent : Mr.C.Emalias, Addl. Public Prosecutor COMMON ORDER The present criminal original petitions have been filed to modify the condition imposed by the learned Principal sessions Judge, Salem, in Crl.M.P.Nos.36 and 42 of 2017 respectively dated 20.1.2017.
2. It is the case of the petitioner that he has been arrayed as an accused in Crime Nos.551 and 552 of 2016 on the file of the respondent police and he was granted bail by the learned Principal sessions Judge, Salem, in Crl.M.P.Nos.36 and 42 of 2017 respectively dated 20.1.2017 on certain conditions. One of the conditions is that he shall stay at Perambalur and report and sign before the learned Judicial Magistrate, Perambalur daily twice at 10.00 a.m. and 5.00 p.m. until further orders”. Since the petitioner is a farmer, he is unable to comply with the said condition. Hence, seeking modification of the said condition, the petitioner has come up with the present petitions.
3. Learned Additional Public Prosecutor has no objection to modify the said condition.
4. In view of the same, the condition imposed on the petitioner in Crl.M.P.Nos.36 and 42 of 2017 respectively dated 20.1.2017 by the learned Principal sessions Judge, Salem, viz., “the petitioner shall stay at Perambalur and report and sign before the learned Judicial Magistrate, Perambalur daily twice at 10.00 a.m. and 5.00 p.m. until further orders” is hereby modified as follows:-
“ The petitioner shall appear before the learned Judicial Magistrate No.II, Sankagiri, on the first working day of every week at 10.30 a.m., for a period of two months.”
The other conditions shall remain unaltered. Both the Criminal Original Petitions are ordered accordingly.
