JUDGMENT / ORDER

…Accused This CCC is filed under Sections 11 and 12 of the Contempt of Courts Act 1971, by the complainant, wherein she prays that the Hon’ble High Court be pleased to initiate contempt of Court proceedings against the accused for willful and deliberate dis-obedience of the order dated 28.11.2014, in W.P.No.48369-48371/2014 (KLR- RES).
This CCC coming on for Preliminary Hearing, this day, B.S.Patil J, made the following:-
ORDER 1. Party-in-person in this contempt petition has alleged violation of order dated 28.11.2017 in W.P.Nos.48369-48371/2014.
2. We have heard Smt. Venkatamma, party-in- person and perused entire materials on record. We find from Annexure-B, order passed by the Tahsildar, Devanahalli on 09.03.2015 that, by referring to the direction issued in W.P.Nos.48369-48371/2014, he has passed a considered order holding that request made by complainant to enter her name in the khatha in respect of the land in question could not be acceded as the matter was sub-judice. Therefore, direction issued by this Court to the Tahsildar to consider and hear the petitioner and third respondent in the aforesaid writ petitions and thereafter, pass orders in accordance with law, has been complied with.
3. Hence, there is no case made out for initiation of contempt proceedings. If the complainant is aggrieved by the order passed by the Tahsildar or any other action of the Revenue Authorities with regard to the request made by her for entering her name in Revenue Records, it is open for her to seek redressal in accordance with law.
Reserving such liberty, this contempt petition is closed.
