S.Nagesh, Advocate for R2) This Criminal Petition is filed under Section 482 of Cr.P.C. praying to quash the charge sheet in Cr.No.87/2016 at Annexure-F submitted by the 1st respondent police and the proceedings in C.C.No.252/2017 on the file of the learned II Additional Senior Civil Judge and JMFC, Tumkuru.
This Criminal Petition coming on for Admission, this day, the Court made the following:
O R D E R When the matter was taken up for hearing, the learned counsel for the petitioners has brought to the notice of the Court that the discharge application filed by the petitioners was dismissed by a considered order dated 28.12.2018. Instant petition was filed and stay was granted subsequent to the said order. Hence, the present petition is not maintainable.
In view of the above, the learned counsel for the petitioners seeks leave to withdraw the petition reserving liberty to the petitioners to challenge the order dated 28.12.2018 rejecting the discharge application filed by the petitioners.
Reserving liberty as prayed for, petition is disposed of.
