HON’BLE SRI JUSTICE ASHUTOSH MOHUNTA AND HON’BLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No. 12235 of 2014 ORDER : (per Hon'ble Sri Justice Ashutosh Mohunta) The petitioner has prayed for quashing the order bearing No.54279 dated 14.11.2013 passed by the Deputy Commercial Tax Officer-I, Hydernagar Circle.
2. Sri P. Balaji Varma, learned counsel for the respondents submits that the petitioner has not filed the complete assessment order under challenge. However, learned counsel for the petitioner submits that the petitioner has received only one page order under challenge from the respondents and he has also filed a representation on 25.04.2014 before the competent authority to supply the complete order. But, the same has not been supplied so far, therefore, the case may be decided on the basis of the order supplied to the petitioner.
3. As the petitioner failed to file the complete assessment order under challenge, the issue cannot be decided in this writ petition. Therefore, the petitioner shall obtain the complete assessment order under challenge from the authority, who passed it and thereafter challenge the same. As the petitioner has already filed an application for supply of the order dated 14.11.2013 passed by the Deputy Commercial Tax Officer-I, Hydernagar Circle, the aforesaid authority shall supply the complete order to the petitioner within a period of four weeks from today.
4. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
5. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
