THE HON'BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No.4686 of 2012 ORDER:
This petition is filed to quash P.R.C.No.11/2012 on the file of Additional Judicial First Class Magistrate, Srikakulam for alleged offences under Sections 447, 427, 506 (2) read with 34 IPC and also Sections 3 (1) (x) and (xi) of Scheduled Castes and Scheduled Tribes (POA), Act, 1989.
2. Heard Advocate for petitioner.
3. I have perused the material papers filed along with quash petition. In the charge sheet, the petitioner is shown as A15 and he was found absconding and this Court, by an order, dated 30-05-2012, directed the petitioner to surrender before the Special Court and to file a petition to recall the warrant with a direction to learned Judge to consider the same. It is submitted that the petitioner has complied that direction and surrendered before the Court below and now the case is still pending at the stage of PRC. Considering these aspects, I feel that the petition can be disposed of directing the Court below to expedite the PRC proceedings and by giving liberty to the petitioner to urge all these grounds during trial.
4. With the above observation, Criminal Petition is dismissed at admission stage.
5. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
