JUDGMENT / ORDER

Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct to enlarge the Petitioner herein on Bail in the event of her arrest in Crime No. 41 of 2014 on the file of Pusapatirega Police Station, Vizianagaram District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri P. Durga Prasad, Advocate for the Petitioner and of the Public Prosecutor on behalf of Respondent- State, the Court made the following.
ORDER:-
“The petitioner is A2. She seeks for grant of anticipatory bail. She allegedly committed offences under Sections 420, 468 and 471 read with Section 34 IPC.
The learned Additional Public Prosecutor submitted that as much as Rs. 24 Crores are involved in this case and that this is not a fit case for grant of anticipatory bail.
The learned Senior Counsel representing the petitioner submitted that there was no complicity on the part of the petitioner in the commission of any of the offences. He contended that A1 took premises of A2 on lease where he raised construction. It is alleged that A1 raised construction with the funds of the de-facto complainant. Be it noted that A1 is a NGO. A2 is not part of A1 Organisation. The learned Senior Counsel contended that the petitioner has nothing to do with the cheating, if any, resorted to by A1. He also submitted that an agreement has been entered into recently between A1 and A2 that A1 should purchase the immovable property of A2, over which A1 raised constructions. In view of the detailed contentions of the petitioner, in view of the nature of the allegations against A2 and in view of the fact that A2 is a lady, I consider it appropriate to enlarge the petitioner on anticipatory bail.

Consequently, this Criminal Petition is allowed. The petitioner shall surrender before the learned Additional Judicial First Class Magistrate, Vizianagaram, within two weeks from today. On such surrender, the learned Additional Judicial First Class Magistrate, Vizianagaram shall enlarge the petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.
