Respondents 1 and 2 in HCP.No.189/2017 Prayer in H.C.P.No.110 of 2017: Petition filed under Article 226 of the Constitution for the issuance of a Writ of Habeas Corpus directing the respondents to produce the body of the petitioner's daughter by name J.Geetha, D/o.Jayaraman, aged 20 years, before this Court and further, may handover the petitioner's daughter to her custody.
Prayer in H.C.P.No.189 of 2017: Petition filed under Article 226 of the Constitution for the issuance of a Writ of Habeas Corpus directing the 1st and 2nd respondents to produce the detenue, namely, K.Sankar, son of Kalyanasundaram, ordinarily residing at No.70, Ram 5th Street, Shanmuga Nagar, Pozhichalur, Chennai 600 074 and presently under confinement of the 2nd respondent and set him at liberty.
For petitioner in HCP.No.110/17 : Mr.V.R.Sudhakaran For petitioner in HCP.No.189/17 : Mr.M.K.Sathish For 1st Respondent in both HCPs : Mr.V.M.R.Rajentren, Addl Public Prosecutor O R D E R (Order of this Court was made by Justice S.MANIKUMAR) In H.C.P.No.110 of 2017, mother has sought for a Writ of Habeas Corpus, for production of her daughter, J.Geetha, D/o.Jayaraman, aged 20 years. One Shankar has been added as 2nd respondent herein. In H.C.P.No.189 of 2017, wife has sought for a Writ of Habeas Corpus, for production of her husband, K.Sankar, son of Kalyanasundaram. She has arrayed one Moorthy, as 2nd respondent.
2. On instructions from the Inspector of Police, S-6, Sankar Nagar Police Station, Pammal, Chennai 600 075, learned Additional Public Prosecutor, submitted that the alleged detenue in H.C.P.No.189 of 2017, is involved in other HCP and thus, they are connected together. He further submitted that insofar as the complaint preferred in Cr.No.317 of 2017, the alleged detenue, J.Geetha, D/o.Jayaraman, has been secured.
3. Learned Additional Public Prosecutor submitted that on the complaint of the wife in H.C.P.No.189 of 2017, FIR in Cr.No.353 of 2017, has been registered and on investigation, it was found that the 2nd respondent therein, is no way involved in the alleged man missing case. He also added that the alleged detenue, K.Sankar, son of Kalyanasundaram, has also been secured.
4. Both the alleged detenues are present. Mother of J.Geetha, D/o.Jayaraman, is also present. We have enquired J.Geetha, D/o.Jayaraman and she wants to go with her mother. She also denies detention by K.Sankar, son of Kalyanasundaram.
