This Criminal Petition is filed to quash proceedings in CC.No. 192 of 2011 on the file of Additional Junior Civil Judge, Srikalahasti, Chittoor district.
2. Heard both sides.
3. It is the contention of Advocate for petitioners, there are civil disputes and due to those disputes present compliant is given implicating all the family members. He submitted that second petitioner and fourth petitioner are employees working at different places and they are also implicated and fifth petitioner is a senior citizen and he is aged about 71 years.
4. I have perused the material papers filed alongwith this criminal petition.
5. The lower court after considering sworn statements of the complainant and witness took cognizance of the offence and the objections raised on behalf of petitioners are defences which are to be decided only during trial. At this stage, correctness of the sworn statements of the witnesses and complaint allegations cannot be decided. However, considering the fact that second and fourth petitioners are employees and fifth petitioner is a senior citizen, I feel this criminal petition can be disposed of by directing the court below to expedite trial and dispose of the same within stipulated time by dispensing with the presence of petitioners 2, 4 and 5 for each and every adjournment.
6. Accordingly, this Criminal Petition is disposed of directing the court below to take up trial of the case and dispose it of as expeditiously as possible, preferably within six months from the date of receipt of copy of this order and presence of petitioners 2, 4 and 5 is dispensed with for each and every adjournment. However, they shall appear as and when the court below feels that their physical presence is necessary for any specific purpose.
