The learned counsel for the appellant filed a memo, dated 16.02.2017, indicating that the sole respondent died on 10.12.2004 and the appellant also died on 18.03.2014. Further, it is stated that the appellant is the sole legal representative of the respondent.

2. Recording the Memo, dated 16.02.2017 and in view of the fact that both the parties died leaving behind no legal representative, nothing survives in this second appeal. Hence, the second appeal is dismissed as abated. No costs. Consequently, connected civil miscellaneous petition is closed.
