JUDGMENT / ORDER

1. By way of this petition under Article 226 of the Constitution of India, the petitioner has prayed for the following reliefs:-
"a) This Hon'ble Court will be pleased to admit and allow this petition;
b). This Hon'ble Court will be pleased to issue writ of mandamus or any other appropriate writ, order or direction expediting the appeal being Appeal Case No.JMN/R.J.T./58/2009 filed by the petitioner before the Special Secretary (Appeals), Revenue Department, State of Gujarat and to dispose of the same as early as possible preferably within three months;
c). Pending admission, hearing and final disposal of this petition, this Hon'ble Court will be pleased to appropriate order or direction expediting the appeal being Appeal Case No.JMN/R.J.T./58/2009 filed by the petitioner before the Special Secretary (Appeals), Revenue Department, State of Gujarat and to dispose of the same as early as possible preferably within three months;
d). Any other and further orders which this Hon'ble Court deems fit and just be granted in the interest of equity, justice and good conscious."
2. Heard Mr. Prasad A. Hurra, learned advocate for the petitioner and Ms. Asmita Patel, learned AGP for respondent No.1 on advance copy served.
3. Considering the prayers prayed for and also considering the fact that the proceedings are pending since 2009, it would be open for the petitioner to file an appropriate application for expediting the hearing of Revision Application No.JMN/RJT/58/2009 pending before it as expeditiously as possible. As and when such an application is filed, the Special Secretary (Appeals) shall decide such application after hearing the petitioner and fix the main Revision Application as early as possible.
4. With these observations, the petition is disposed of.
