HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION Nos.4116 & 4156 of 2012 COMMON ORDER:
These two criminal petitions are filed to quash F.I.R. in Crime No.225 of 2012 of Chebrolu Police Station of West Godavari District for alleged offence under Section 420 read with 34 IPC.
2. Heard both sides.
3. Advocate for petitioners submitted the allegation against the petitioners is that they have drawn excess amount towards the value of supply of paddy through the collection agency. Advocate for petitioners submitted all the petitioners belong to same family and they are innocent and they have not committed any offence. However, they are ready to co-operate with the police for investigation and till completion of investigation, their arrest may be prevented.
4. According to the learned Public Prosecutor, the matter is under investigation and so far, nine witnesses are examined, but because of the stay, they could not proceed further.
5. Considering the submissions of both sides, I feel that the petitions can be disposed of by directing the police to expedite the investigation and file the final report and till such time, they shall not arrest the petitioners.
6. Accordingly, the Criminal Petitions are disposed of directing the Station House Officer, Chebrolu Police Station, West Godavari District, to complete investigation, as expeditiously as possible, and file the final report, and till completion of investigation and filing of final report, they are prevented from arresting the petitioners. Miscellaneous petitions, if any, pending in these criminal petitions shall stand closed.
