ORDER:
This writ petition is filed for a Mandamus to set aside proceedings in Rc.No.2350/2014-C dated 03.09.2014 of respondent No.2, whereby he has ordered institution of inquiry under Section 51 of the Andhra Pradesh Co-operative Societies Act, 1964.
At the hearing, Smt. Jyothi Eswar Gogineni, learned counsel for the petitioner, has stated that for the time being, her client will be satisfied if its representation dated 17.09.2014 made to respondent No.2, for re-considering his decision ordering inquiry, is considered and appropriate decision is taken, after giving an opportunity of personal hearing to the President of the petitioner.
In view of the afore-said submission, I refrain from examining the case on merits. Respondent No.2 is directed to consider the petitioner’s representation stated to have been received on 17.09.2014 after giving a notice and an opportunity of personal hearing to Mr.
B.V.K. Mohan Reddy, President of the petitioner. The respondents are directed not to proceed with the inquiry in pursuance of the impugned proceedings till the above directed process is completed by respondent No.2 and his order communicated to the President of the petitioner.
Subject to the above directions, the writ petition is disposed of. As a sequel to the disposal of the writ petition, W.P.M.P.No.39319 of 2014 shall stand disposed of as infructuous.
