ORDER:
Heard learned Counsel for the petitioner and learned Counsel for the third respondent.
This Writ Petition was filed challenging the action of the respondents in not allowing the petitioner to deposit the advance amount and in not allotting the shop to him in the newly constructed shopping complex of the third respondent situated at Narasaraopet, Guntur District on a monthly rental basis.
At the time of filing the present Writ Petition on 18.08.2009, this Court passed an order directing the third respondent to maintain status quo with regard to allotment of the shop inasmuch as it was stated by the learned Standing Counsel for the Marketing Committee that the shops were already allotted to the third parties.
Learned Counsel for the third respondent submits that allotment of shops in favour of third parties was made in the year 2009 for a period of five years and the lease period also expired subsequently and that the shops a+re kept open for allotment.
In view of the aforesaid submissions of the learned Counsel for the third respondent, the Writ Petition is disposed of giving liberty to the petitioner to participate in the allotment process of shops if he is otherwise eligible as and when the shops kept for auction of its leasehold rights.
The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
