Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and Sri Sher Bahadur Singh, learned counsel appearing for the Gram Sabha.
Present petition has been for seeking a direction to the respondent No. 2/ District Magistrate, Pilibhit to decide the complaint/ representation of the petitioner dated 02.02.2021 and 05.02.2021, within stipulated period.
The complaint is being made against the Gram Pradhan, however, the concerned Gram Pradhan is not impleaded as necessary party in the present petition, therefore, I am not inclined to entertain the petition, particularly, in view of the fact that the elections are already over and person concerned is no more functioning as Pradhan of the village.
Admitting this position, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to pursue the remedy as may be available to the petitioner in accordance with law.
Accordingly, present petition stands dismissed as withdrawn with liberty aforesaid.
