Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Applicant- Veerpal seeks anticipatory bail in Case Crime No. 108 of 2020, under Sections 420, 467, 468, 471 IPC, Police Station Garotha, District Jhansi Learned counsel for the applicant has submitted that the applicant is wholly innocent and has been falsely implicated in the present case due to ulterior motive.
Learned counsel for the applicant has next submitted that no sale deed has been executed in the name of applicant and also, he was not present at the time of execution of sale deed.
Learned counsel for the applicant has next submitted that even from the allegations made in the FIR, no offence is made out against the applicant, as such, he be released on anticipatory bail.
Per contra, learned AGA has vehemently opposed the prayer for anticipatory bail and has submitted that by misrepresenting himself to be a member of Scheduled Caste, applicant surreptitiously and deceitfully had got the sale deed executed in his name, though in fact, caste of applicant is 'Ahir.'
In view of the aforesaid facts and looking to the gravity and seriousness of the accusations and complicity of the applicant, I do not find it is a fit case for anticipatory bail.
