The present writ petition has been filed praying for a writ of mandamus commanding the revenue authorities, i.e., respondent Nos. 2 to 5 to remove the alleged encroachments made by respondent No. 6 over plot No. 1430, which the petitioner alleges to be Gaon Sabha property.
In the counter affidavit filed by Tehsildar, Tehsil-Sadar, District-Azamgarh, it has been stated that after due enquiry no encroachments were found over the aforesaid plot . This Court vide order dated 16.5.2018 had granted the petitioner two weeks' time to file his rejoinder affidavit, but no rejoinder affidavit has been filed till date.
In view of the aforesaid and in view of the statement made in the counter affidavit that no encroachments were found over Plot No. 1430, which is recorded as pond in the revenue records, no orders are required to be passed in the present writ petition.
The writ petition is accordingly dismissed.
