This application under Section 482 of Cr.P.C. has been filed with the prayer to quash the impugned order dated 28.06.2019 passed by Additional Civil Judge-I (J.D.)/Judicial Magistrate, Shahjahanpur in Misc. Case No. 1173 of 2018, under Sections 156(3) Cr.P.C. at Police Station Mirzapur, District Shahjahanpur.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
At the very outset, objection has been raised by learned A.G.A. that the applicant is the prospective accused in the application moved under Section 156(3) Cr.P.C. and therefore, this application is not maintainable in the light of the law laid by the Full Bench of this Court in the case of Father Thomas v. State of U.P., 2011 CrLJ 2278 All.
Counsel for the applicant has not been able to give any adequate reply to the objections raised by learned A.G.A.
Therefore, the application stands dismissed as not maintainable.
