Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicant Veerpal in Case Crime No. 327 of 2021, under sections 420, 467, 468 & 471 I.P.C., P.S. Dibiyapur, District Auraiya.
The allegation against the applicant in the FIR is that he made forged appointment letter which he claims to have been issued by the Director General Health, Uttar Pradesh, Lucknow and produced the same for getting appointment. The fact was that no such appointment letter was issued for appointment as dying-in-harness.
Submission of the learned counsel for the applicant is that the applicant has been falsely implicated in this case and he did not commit any forgery. It has been further submitted that he was seeking job and came in contact with one K.P. Singh, who promised him for a job and in lieu he took Rs. 4 lacs from him. Thereafter, he got the appointment letter such K.P. Singh and even though he pointed out that he does not come in category of dying-in-harness, he ignored the same assuring him that he will manage everything. Further submissions is that there is no role in the alleged forgery of the applicant, therefore, it is a fit case for anticipatory bail. It is further submitted that applicant has no criminal history and applicant is prepared to furnish sureties and bonds, there is no possibility of her either fleeing away from the judicial process or tampering with the evidence.
Learned AGA has vehemently opposed the prayer of bail.
Considered the submissions of both the sides. The matter appears to be serious as a letter of appointment was concocted and it was alleged that the same was issued by the Director General Health, Uttar Pradesh, Lucknow. As such, considering the seriousness of the matter, I do not find any ground for giving benefit of anticipatory bail, hence the anticipatory bail application filed by the applicant is rejected.
