This writ petition is filed for declaring the action of the 2nd respondent in not disposing of the appeal against the orders of cancellation dated 08-11-2012 in respect of petitioner's fair price shop at Yedakulapally village, Jharasangam Mandal, Medak District as illegal and arbitrary.
2. The case of the petitioner is that the petitioner is a fair price shop dealer appointed in 1990 and has been distributing essential commodities to the card holders without any complaint and his authorisation is being renewed from time to time and valid till March, 2012. The authorisation of the petitioner was suspended by the 3rd respondent on a preliminary enquiry alleging certain allegations against the petitioner against which the petitioner filed an appeal on 11-12-2013 along with stay petition before the 2nd respondent-Joint Collector, Medak, but no orders are passed on the same. Aggrieved by the same, the present writ petition is filed.
3. Learned Assistant Government Pleader for Civil Supplies states that an appeal should be filed within one month from the date of communication of the order and the petitioner filed the appeal on 11-12-2013.
4. Since it is stated that the petitioner filed the appeal against the suspension of his authorisation before the 2nd respondent, it is for the 2nd respondent to consider the same and pass appropriate orders.
5. In view of the above, the 2nd respondent is directed to consider the appeal filed by the petitioner and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of the order.
6. With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
