Heard the learned counsel for the applicant and Sri S.K. Mishra and Sri Vivek Mishra, learned counsel for the opposite party.
The instant contempt petition has been filed against the order dated 19 June 2019, wherein, a direction was issued to the petitioner/applicant to deposit within three days the amount before the Court.
It is urged that the petitioner in compliance of the order deposited the amount, further, there is no other order against the respondent-bank before the writ court.
On specific query, learned counsel for the applicant submits that the writ petition is pending and during pendency of the writ petition, bank has revoked the bank guarantee, hence, it is urged that the writ court order has been flouted.
On repeated request, learned counsel for the applicant is unable to point out from the order of the writ court whether there was any restrained order against the bank for revoking the bank guarantee.
The contempt petition being misconceived, is accordingly, dismissed with liberty to the applicant to pursue his remedy before the writ court.
