The instant petition has been filed challenging the order dated 5.10.2018 summoning the applicants under Sections 323, 354- A, 504, 506 IPC in Complaint Case No.672 of 2018, Police Station Civil Lines, District Budaun.
The submission is that a false complaint has been made inasmuch as a matrimonial dispute is pending between the parties.
A perusal of the impugned order shows that the trial court has recorded statements under Section 200 and 202 Cr.P.C. and has recorded its satisfaction that there is prima facie evidence to proceed against the applicants.
I find no reason to take a contrary view.
The petition lacks merit and is accordingly dismissed.
In case bail application is filed, the trial court shall keep in mind the guidelines issued by the Supreme Court vide order dated 7.10.2021 in Special Leave to Appeal (Criminal) No.519 of 2021 Surender Kumar Antil Vs. C.B.I. and another.
