The prayer for measurement of plot no.340 and 333 cannot be accepted at this stage for the fact that both the plot are of co- ownership of the petitioner and his brother and are subject matter of the suit for partition filed under Section 176 of the U.P. Z.A. & L.R. Act 1950. No details has been given with regard to the decree, if any passed by the competent revenue court.
At this stage, learned counsel for the petitioner prays for and is granted permission to withdraw the present petition with liberty to file a fresh with correct details.
In view of the above, the present petition is dismissed with liberty as aforesaid.
