Learned counsel for the applicant has submitted that earlier the F.I.R. was lodged against the applicant under section 452,323,504, 313 I.P.C. and his bail application was also rejected by court below under the said sections.
Learned counsel for the applicant has further submitted that the charge sheet has now been submitted only under section 504 I.P.C and as such he may be permitted to withdraw the present bail application so that he may move bail application before the court below under the appropriate section.
The prayer is allowed.
The bail application is dismissed as withdrawn.
