This application under Section 482 Cr.P.C. has been filed for quashing the charge-sheet dated 13.4.2010 arising out of N.C.R. No. 13/2008, under Sections 323, 504, 506 IPC, Police Station Phephana, District Ballia pending in the Court of C.J.M., Ballia as well as proceedings of Case No. 2203 of 2017 (State vs. Veer Bahadur Giri and 3 others).
Heard Sri Ishan Deo Giri, learned counsel for the applicants and learned AGA for the State.
At the very outset, learned counsel for the applicants has submitted that all the applicants want to surrender before the learned trial Court and some time may be granted in this regard with further direction for expeditious disposal of their bail application.
Learned AGA has no objection with the submission made by the learned counsel for the applicants.
Looking into the facts and circumstances of the case as well as submission made by the learned counsel for the applicants, the prayer made by the learned counsel for the applicants is hereby refused.
However, it is provided that if the applicants appear or surrender before the Court concerned within 45 days from today and apply for bail in the aforesaid case, their prayer for bail shall be considered as expeditiously as possible by the court below in accordance with law.
With aforesaid direction /observation, the instant application finally stands disposed of.
