Petitioner is aggrieved by denial of promotion to him on the post of Sub-Inspector as well as grant of promotion to his juniors, who were also awarded adverse entry, like the writ petitioner.
Learned Standing Counsel points out that there is no averment in this petition that the private respondents have not represented against the adverse entry or that it has not been stayed or set aside.
So for as the petitioner is concerned, it is admitted that an adverse entry has been awarded to her in the year 2011. By virtue of Government Order dated 30.9.1993, the services are not liable to be treated as satisfactory for a period of 5 years in case an adverse entry is awarded to a candidate. As petitioner's past 5 years working is not satisfactory, she cannot be considered for promotion. In such circumstances, no interference is called for with the order dated 28.2.2018 in so far as promotion is denied to the writ petitioner.
Writ petition fails and is accordingly dismissed.
