The petitioner is the owner of a stage carriage, bearing Registration No.KL-05/Q 7279, who was granted temporary permit on the route Varkala Junction-Paripally ESI Hospital in the vacancy of a regular stage carriage bearing Registration No. KL-16/D 4302. It is the contention of the petitioner that, since the temporary permit obtained by her was only for 20 days, she has to approach the Tribunal in every 20 days. In order to operate the service without break, the petitioner submitted an application for issue of temporary permit for four months, by Ext.P4 dated 16.10.2014. It is submitted that no steps are taken on Ext.P4. 2. If vacancy of stage carriage bearing Registration No.KL KL 16/D 4302 is still in existence and no other person, having better claim, has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the respondent to issue temporary permit of four WPC.27805/2014 : 2 :
months duration, within one week from the date of receipt of a copy of this judgment by passing appropriate orders on Ext.P4. Needless to say, such issuance of temporary permit will be subject to the preferential claim, if any.
Writ petition is disposed of as above.
