Heard Mr. Ashutosh Mishra holding brief of Mr. Rohit Ranjan, learned counsel for petitioner as well as learned Additional Government Advocate for the State.
This writ petition has been filed challenging FIR dated 17.5.2021 registered at FIR/Case Crime No.0213 of 2021, under Sections 143/147/148/149/307/504/506/109/120B/216 IPC and Section 7 of Criminal Law Amendment Act at Police Station Maurawan, District Unnao.
After arguing the matter at some length, learned counsel for the petitioner states that he may be permitted to withdraw this writ petition with liberty to the petitioner to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioner approaches the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
