In this case, the interim order was passed on 19.9.2006 staying the further proceedings of Case No. 152 of 2005 (Parmanand Rai Vs. Ved Prakash and others) under Sections 427, 504, 506 IPC pending before the court of Civil Judge, (J.D.), Basgaon, Gorakhpur till the next date of listing.
The interim order was lastly extended on 15.12.2006 but thereafter the case was listed on 23.1.2020, 27.10.2021 and 17.11.2021 but the interim order was not extended.
On 28.3.2018, the Apex Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd and others vs. Central Bureau of Investigation; AIR 2018 SC 2039 has directed that in all pending cases where stay against proceedings of a civil or criminal trial is operating, the same will come to an end on expiry of six months from today unless in an exceptional case by a speaking order such stay is extended. In the present case, the interim order was not extended and it stands vacated.
In view of above, the present application u/s 482 Cr.P.C. is dismissed for the want of prosecution.
