1. Order dated 23.02.2018 having been recalled vide order of date passed on Recall Application, writ petition is restored to its original number.
2. As requested and agreed by learned counsel for parties, I proceed to hear and decide this case at this stage finally.
3. Heard Sri Vinod Dwivedi, learned counsel for petitioner, learned Standing Counsel for State and perused the material available on record.
4. Admittedly, petitioner was initially working as Collection Peon in Tehsil-Basti Sadar from 21.01.1995 to 31.12.1995. Thereafter, he has been engaged as Collection Amin and then Seasonal Collection Amin on ad-hoc basis from time to time.
5. When respondents found that recovery made by petitioner was inadequate, therefore, he has not been engaged further.
6. When questioned, learned counsel for petitioner could not dispute this fact that recovery made by petitioner was inadequate and there is no right of petitioner to claim continuous engagement.
7. In view of above, I do not find any reason to interfere with the impugned order. The writ petition lacks merit and is, accordingly, dismissed.
