M/S Ved Prakash And Sons And ... vs Indian Overseas Bank And Another

High Court Of Judicature at Allahabad|28 June, 2010

JUDGMENT / ORDER

Hon'ble Rajesh Chandra,J.
Heard learned counsel for the petitioner and Sri Manish Mehrotra, learned Advocate who appeared for the respondent Bank.
There is no dispute about the fact that earlier to challenge the recovery proceeding writ petition No. 1820 of 2010 was filed by the petitioner which was disposed by this court on 18.1.2010 and thereafter application for extending time to deposit the amount was also disposed of on 20.5.2010 and liberty/indulgence was given by this court. Now again default is claimed and the prayer is for grant of some more liberty.
In view of the aforesaid we are not inclined to entertain the matter again and again at the instance of the petitioner who came to this court twice.
In view of the aforesaid this petition fails and is dismissed.
However, petitioner may seek other remedy which may be available to him.
