Heard counsel for the petitioner and Standing Counsel for State.
The writ petition has been filed for mandamus directing the Collector, respondent-2 to recover the amount of recovery certificate dated 1.7.2017.
It has been stated that in the matter of industrial dispute, the Industrial Tribunal by the award dated 30.9.2011 had directed reinstatement of the petitioner in service. The employer is not complying with the award therefore, the petitioner filed an application under Section 6 H (1) of UP Industrial Disputes Act, 1947 on which the Assistant Labour Commissioner assessed the amount of wages of the petitioner and issued recovery certificate by order dated 1.7.2017 for realization of amount of Rs. 4,87,823/-. Although recovery certificate has been received in the office of Collector but amount has not been realized till today.
The writ petition is disposed of with direction to the Collector to realize the amount in pursuance of recovery certificate dated 1.7.2017 issued by Assistant Labour Commissioner, within a period of two months from the date of producing a certified copy of this order before him and submit the amount before Assistant Labour Commissioner for its disbursement.
