This petition is directed against an order passed by the Vice Chancellor, Sampurnanand Sanskrit Vishwavidyalay, Varanasi dated 28.1.2018, whereby petitioner's representation made against the selection of respondent no. 4, on the post of Principal has been rejected. It appears that proceedings were initiated for selection on the post of Principal of 'Saraswati Brhamcharyashram Sanskrit Degree College, Parmath, Kanpur Nagar, in which alongwith respondent no. 4, petitioner had also participated. In terms of the Statute of the University, the selection committee was constituted which has found respondent no. 4 to be suitable for selection to the post in question. Claim of the petitioner has also been considered but the selection committee has not found him suitable. It is this action which has given cause to the petitioner for approaching this Court.
The only ground of challenge to the order of the Vice Chancellor of the University is that respondent no. 4 was a student in the same college between 2007 to 2010 and, therefore, he could not have been a member of the teaching staff for the same period. Although it is stated in para-22 of the Writ petition that respondent no. 4 was a student in the same college during such period, but apart from bald averments in that regard, the facts have not been substantiated in any manner. Even otherwise, the post itself is a selection post and the minimum qualification required for appointment is not disputed so far as respondent no. 4 is concerned. The recommendation of the selection committee has already been accepted and acted upon. The eligibility of respondent for appointment to the post is also not challenged. In such circumstances, merely on the basis of unsubstantiated claim contained in para-22 of the writ petition, no interference would be required in the matter.
Writ petition fails and is consigned to records.
