Heard learned counsel for the applicants and Shri Ajay Kumar Yadav, learned counsel for the opposite parties.
The applicants are before this Court against wilful defiance of the order dated 5.10.2018 passed in Writ-C No.33584 of 2018 (Ved Prakash Jain v. State of U.P. & Ors.).
Admittedly in response to the writ Court order in question the opposite party no.1 has accepted the claim set by the applicant qua the subsidy, which is liable to be extended by the department concerned. So far as newly impleaded opposite party no.3 is concerned, a statement has been made at Bar by learned counsel appearing on his behalf that the electricity has already been restored vide order dated 21.8.2019.
On the basis of supplementary affidavit filed today the applicant claims that certain excess amount has been deposited by him, which is liable to be returned by the department concerned. Needless to say, the said relief has not been extended by the writ Court. However, it is always open to the applicant to press the said relief before the appropriate forum.
The contempt application stands disposed of. Notices, if any, stand discharged.
