Sri Ishan Shishu, learned Advocate, has filed memo of appearance on behalf of respondent no.1-Union of India today in Court, which is taken on record.
Heard Sri Yash Padia, learned counsel for the petitioner, Sri Vikas Budhwar, learned counsel appearing for respondents Petroleum Corporation, Sri ishan Shishu, learned counsel appearing for respondent no.1 and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has challenged the order dated 22.11.2019 passed by respondent no.2 whereby the candidature of the petitioner has come to be rejected on the ground that the area of land that has been offered by the petitioner is less than the required one under the advertisement.
Learned counsel for the respondent Corporation submits that the petitioner has an opportunity to move an appropriate application/complaint against the order impugned before the competent authority under Clause 18 of the Brochure/ Guidelines along with the requisite fee and that can be decided.
In view of the above, we are disposing of this writ petition with a direction that in case the petitioner moves an appropriate application before the competent authority of the respondent Corporation in compliance of the provisions contained under Clause 18 of the Brochure along with the requisite fee within a period of four weeks from today, the same shall be examined in accordance with law on merits by the respondent concerned before finalizing any allotment proceeding in respect of the location advertised within a further period of four weeks.
With the aforesaid observations and directions, the writ petition stands disposed of.
