Learned counsel for the appellant does not press the Writ Appeal as his client wants to approach the civil Court to establish his title.
In view of aforesaid submission, we close this appeal giving liberty to the appellant to approach appropriate civil Court in accordance with law. We make it clear that this observation may not constitute to be any finding in favour of the appellant. The civil Court will obviously proceed in accordance with law. No order as to costs.
Consequently, miscellaneous petitions, if any pending, shall stand closed.
