ORDER:
Petitioners question the ex parte interim order of suspension passed by the third respondent in an ROR appeal said to have been filed by respondent No.7.
2. Petitioners submit that on account of the said impugned order, the pattadar pass books and title deeds issued to the petitioners in the year 2011 were stayed by the third respondent. Petitioners question the said order on the ground of locus standi of respondent No.7 to maintain the appeal and also on the merits.
3. However, since the order impugned is an ex parte interim order passed by the third respondent, as an appellate authority under the A.P. Rights in Land and Pattadar Pass Books Act, I am not inclined to entertain the writ petition. However, the petitioners are at liberty to approach the third respondent with an appropriate application seeking vacation of the said order by filing their counter affidavit.
The writ petition is, therefore, disposed of directing the third respondent to consider the application of the petitioners for vacation/modification of the said interim order, expeditiously, after hearing respondent No.7 and pass appropriate orders thereon on priority basis. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
