Judgment:
This Civil Miscellaneous Appeal (CMA) is filed against Order, dated 18-10-2010, passed in IA.No.315 of 2008 in OS.No.10 of 2008, on the file of the Court of the learned I Additional District Judge, Eluru, West Godavari District, whereby the appellant’s application for grant of temporary injunction was dismissed.
At the hearing, Mr.M.P.Chandramouli, learned Counsel for the appellant, has submitted that as the suit itself is coming up for trial, his client does not intend to pursue this CMA. Accordingly, he requested for permission of the Court to withdraw the CMA.
The request of the learned Counsel for the appellant is accepted and the CMA is dismissed as withdrawn.
As a sequel, CMAMP.No.1732 of 2011, filed by the appellant for interim relief, is disposed of as infructuous.
